ResNet Terms and Conditions

If you wish to receive ResNet access you must agree to abide by the Terms and Conditions laid out in this document. If you fail to abide by these guidelines, your connection may be permanently suspended. By using ResNet, or the network/Internet access it provides, you agree to these Terms and Conditions.

1. Scope

1.1 Connection to ResNet is for accepted academic purposes only. Access to the University Network, JA.NET and the Internet is subject to the conditions that apply to those networks. The University Network and JA.NET are for teaching and research purposes only. The University may immediately withdraw ResNet from your use without notice if there is evidence or reasonable grounds to believe that a connection is being used for other purposes, or in the event that you commit what the University considers to be a serious or material breach of this Contract. If it does so, the University will notify you by electronic mail, telephone, or in writing of the reason why the service has been withdrawn from your use.

2. Terms and Conditions

2.1 In using ResNet you must comply at all times with the University Conditions for use of Computers; and with the JA.NET (Joint Academic NETwork) Acceptable Use Policy; and The Law. 2.2 Without prejudice to your obligations under clause 2.1 you must not use ResNet:

for the creation, storage, transmission or receipt of a document, communication (email, posting, etc.) or any other material which is defamatory, abusive, offensive, a hoax, or of an obscene, indecent, nuisance, threatening or menacing character; or in a manner which may cause annoyance, inconvenience or needless anxiety to anyone or which may violate or infringe the rights of any person, firm or company; or to commit a fraud or a criminal offence including breach of copyrightfor any commercial purpose (including management of remote services)

2.3 You are solely responsible for all activity undertaken from your connection and you must not allow anyone else to use your connection with your knowledge or consent.

2.4 You must not attach, or permit to be attached, to ResNet anything other than the single computer system which has been registered in your name. You must not attach anything to ResNet that is not authorised by the University for connection to it nor use anything in connection with the ResNet that may in any way harm it or cause any form of annoyance or disruption to the users of the University Network. This specifically forbids the connection of routers, switches, bridges, hubs, wireless access points, multi-homed computers running routing services, or any other network devices or machines providing similar services.

2.5 You must not configure anything you attach to the network to provide any network service of any sort across the network (for example, any version of Windows Server, Linux/Unix Servers, web servers, FTP servers, SSH servers, BOOTP servers, DHCP servers, File Sharing Servers, Internet Connection Sharing, Windows file and printer sharing etc ¿ this list is not exhaustive). If you run such services when your computer is not attached to ResNet (e.g. at home), it is your responsibility to remove such services when you attach to ResNet.

2.6 You must not share your ResNet connection through any form of Internet Connection Sharing, either wired or wireless, nor are you permitted to allow a person who is not a subscriber of ResNet to attach their computer to the network.

2.7 You must not run any sort of peer-to-peer (P2P), or file-sharing activity across ResNet. This includes any application or activity that allows other users to view/access files (e.g. documents, pictures, audio, video etc) resident on your computer; and/or you to view/access files resident on other users¿ computers either on ResNet or the Internet in this manner.

2.8 You must ensure that your computer¿s operating system (O/S) is kept up to date with the latest security patches, and ensure that the version of the O/S on your computer is currently supported by its manufacturer/maintainers.

2.9 You must ensure that you have anti-virus software correctly installed and running on your computer, and that it is updated frequently.

2.10 The University cannot in any way guarantee that the University Network and national and international networks will be available for use at all times or without interruption, and no disruption to, nor deficiency of service will be accepted as any excuse for poor academic performance.

2.11 Users of ResNet are expected to use the email, web, DNS, NTP and other Internet services provided by the University of St Andrews.

2.12 For the avoidance of doubt, ResNet provides a connection to the University of St Andrews¿ privately owned data network, and neither ResNet nor the University of St Andrews is an Internet Service Provider.

2.13 Users of ResNet must configure their machines as prescribed in the documentation for ResNet. In particular, users must set their machines to DHCP assignment of their IP address settings, and must not, under any circumstances set their machines to have static IP assignment.

3. Faults and Suspension

3.1 You may inform the University of any fault in, or problem you have with ResNet, by telephoning or emailing the IT Service Desk. You will need to supply as much information as you can to enable us to investigate the problem.

3.2 The University will investigate any reported fault at their best effort, and use all reasonable endeavours to correct any fault under its control in a timely fashion at no further charge to you unless the fault was caused by your negligence or breach of this Contract in which case the University may make a reasonable charge for any such repair. For the avoidance of any doubt, this fault correction facility applies only to faults in the Service and not to any fault in the operation of the University Network or national and international networks.

3.3 The University may suspend ResNet, in part or whole:

  • to comply with a request or instructions from a governmental or other competent authority.
  • to enable maintenance work to be carried out to the ResNet or to the University Network, such maintenance normally being carried out during vacation times, and during IT Services  ¿At-Risk¿ periods.
  • on reasonable belief that you have breached any of these Terms and Conditions.
  • while investigating any potential breach of any of these Terms and Conditions.
  • on reasonable belief that your use of the service is having a detrimental effect on the service to other users.
  • on the reasonable belief that your computer is infected with a virus, Trojan, worms or other code likely to infect or disrupt other computers on the network.
  • for any other reason deemed necessary by the Director of IT Services, not covered above.

3.4 In the event that an investigation uncovers illegal activity, the University may report this to the appropriate authorities, who may prosecute in the event of a criminal activity or sue in the event of a civil action.

3.5 The University will where practicable give advance notice by email of any disruption to or suspension of the Service and will try to keep such disruption to a minimum.

4. Access

You hereby acknowledge that the University, or its authorised agents or representatives, have the right to enter your room on reasonable oral or written notice during normal daytime hours:

  • to install, connect, inspect, alter, adjust and maintain ResNet.

5. Variation

The University may vary these conditions from time to time. Changes will be published on the web not less than seven days before the changes come into effect.

6. Liability

6.1 The University shall not be liable for breach of any of its obligations including any delay or failure in performance to the extent that such breach is caused by any event beyond its reasonable control.

6.2 Notwithstanding anything else in these conditions of use, the University shall not be liable for harm to business, lost revenues, loss of anticipated savings, lost profits or other indirect or consequential or special losses, whether caused by negligence or otherwise.

6.3 The University will not be liable for loss, damage or inconvenience suffered by you as a result of suspension of ResNet in accordance with this Contract.
