Terms of occupancy for students in residence

Student Accommodation Terms and Conditions of Occupancy

This licence is a legally binding document and it is important that you read it carefully; variations to the terms and conditions set out in this contract is only permitted with the prior written consent of Student Accommodation Services.

The University of St Andrews having its central accommodation office at Residential and Business Services, Student Accommodation Services, Butts Wynd, North Street, St Andrews, Fife, KY16 9AL, a registered Scottish Charity (Charity Number SC013532).

LICENCE AGREEMENT between THE UNIVERSITY OF ST ANDREWS, Residential and Business Services, Student Accommodation Services, Butts Wynd, North Street, St Andrews, Fife, KY16 9AL ('the University') and You, the Student described in the forgoing Offer of Accommodation and your Acceptance of the Offer in relation thereto ('the Offer') undertaking a course of study at the University ('You').  The University hereby lets the Premises to You, for the Period of Licence at the Rent and on the Conditions following:

DEFINITIONS AND INTERPRETATION

'the Period of Licence'  the period during which You are to occupy the Premises as detailed in the offer.

'the Premises'  the single or twin occupation room, as appropriate and as offered to You in terms of the Offer, forming part of the Residence together with the right to access and make use of, where appropriate and so far as necessary, the communal areas and kitchen, passageways, internal stairs, lounge, common passageways, stairwells or annexes all within or around the Residence.

'the Rent'  the Residence fees due by You as detailed in the Offer.

1. DEFINITION OF CONTRACT

1.1 The University shall be entitled but not obliged in each case without requiring any consent from You, to outsource, delegate or sub-contract any of its rights and obligations in terms of this Licence Agreement and Code of Conduct to any third party.  Such third party referred to as 'the Manager'and any such right or obligation so affected referred to as 'an outsourced matter'.  Accordingly, any reference to the University or University office, official, agent or employee in relation to any outsourced matter at the option of the University shall include reference to the Manager and any officer, official, agent or employee of the Manager.

1.2 The accommodation is let to You as a consequence of Your attendance at the University of St Andrews.  This contract is granted to You in accordance with The Housing (Scotland) Act 1988 Schedule 4, Paragraph 7.  This states it is "A tenancy which is granted to a person who is pursuing , or intends to pursue, a course of study provided by a specified educational institution and is so granted either by that institution or by another specified institution or body of persons".

1.3 You hereby agree to reside in the Premises in accordance with the Terms & Conditions of Occupancy, Resident's Guide and the Sponsio Academica and any Rules detailed and drawn to your attention by the University at the Premises.  Behaviour which contravenes any of these Rules may affect any future application made by You to reside in the University's accommodation and the University reserves the right to require You to relocate immediately to alternative accommodation should your behaviour at any time during the Period of Licence constitute a contravention.

1.4 In the event You cease to be a student, the University under the possession of The Housing (Scotland) Act 1988 schedule 5, Paragraph 4, may recover possession of the accommodation.  This policy states "where the let is under a tenancy for a specified period not exceeding 12 months and (a) not later than the date of the commencement of the tenancy the landlord gave notice in writing to the tenant that possession might be recovered on this Ground". This notice is hereby given.

2. ARRIVAL

2.1 Unless otherwise stated, the e-contract is for the full session specified.  Your accommodation is usually available to access from 10am of the day the contract starts unless specifiec within the Resident's Guide or University correspondence.

2.2 If you require accommodation before the start date of Your contract, You should contact Student Accommodation Services at the earliest opportunity.  Accommodation outside of the standard contract dates is subject to availability and additional rental charges.

3. INVENTORY

3.1 Provided, upon Your arrival at the residence, will be two copies of the bedroom and communal area Inventories.  You should check and sign all copies of the Inventory for furnishings, fittings and equipment for Your room and the communal areas of the residence/flat as appropriate.

3.2 If the residence fails to provide an inventory, it is Your responsibility to request one.  You should check the Inventory carefully and record any damage, missing items or repair requests.  Sign and return a copy of the Inventory to the Residential Services Manager/Property Manager within 48 hours of the Your arrival.  If an inventory is not completed and signed within 48 hours, the University may assume that everything is in good order and that the contents are complete and undamaged; You could incur a charge for future work as a result.

4. CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000

4.1 If we have not met with You prior to entering into the contract , You have the right to cancel Your contract by giving Student Accommodation Services written notice (by email, fax or recorded post) within seven working days, beginning on the day after the date the contract becomes binding.   The contract becomes binding on the date when Your agreement to the contract is received by the University not the date You move into the accommodation.

4.2 Distance Selling Regulations no longer apply once we have started to provide the accommodation to You, even if this is within seven days of You agreeing to the contract.  After You collect the keys and/or place belongings in the accommodation and/or move in, it is too late to cancel using these grounds.

4.3 There is no extra charge for booking accommodation by post or other means of distance communication.

4.4 The offer of accommodation and the price remain valid for ten working days from the date Your e-contract is emailed to You, after which the offer will lapse and the University has the right to change the Terms and Conditions of any subsequent offer.

4.5 The contract period is fixed and You will continue to be liable for the rent until You have satisfied all of the terms of the contract.

4.6 In addition to Your statutory cancellation rights which are outlined above, we will accept cancellation (whether we have met You or not) made in writing to Student Accommodation Services on the following 'liability' conditions.

5. LIABILITY

5.1 Returning Students: Cancellation notifications are only acceptable in the form of a signed letter or email from Your University email address up until and including 31st March for the year of occupancy.  All cancellations after the 31st March will be fully liable for 10 weeks rent, including catering costs, if applicable.

5.2 Entrant Students: If you are an entrant student, and You do not notify us that You wish to cancel, but simply fail to turn up at the start of the tenancy, Your room will be held for seven days after the start of the contract.  If You have not contacted Student Accommodation Services in writing by then, we will consider the Accommodation contract cancelled and the room available for re-allocation to another student after this day.  The University accepts no liability for arranging alternative accommodation.  You will incur a £50 administrative charge and You will be liable to pay rent, including catering costs if applicable,  for 10 weeks.

5.3 Living in University Accommodation:  If you who chooses to leave the accommodation before the end of the contract, but are still a registered student, you will be charged a £50 adminstrative fee and liable to pay rent including catering costs, if applicable, for 10 weeks.

5.4 Studying outside St Andrews: If the University of St Andrews requires You to study away from St Andrews as part of your course, You may terminate Your contract providing You give a minimum of four weeks notice in writing and Student Accommodation Services receive Faculty confirmation of Your absence for academic reasons.

5.5 Temporary Leave of Absence or Withdrawal from Studies: If You are temporarily taking leave of absence from Your studies, have had Your studies terminated or are formally withdrawing from the University You are required to contact Student Accommodation Services in writing regarding termination of the contract. You must contact Student Accommodation Services must be contacted as soon as You receive notification from Registry that You are no longer a currently registered student. If you have withdrawn from the University, You are no longer eligible to remain in University accommodation. Should you require more than 5 days to vacate the accommodation You must contact Student Accommodation Services in writing to confirm the date You will be leaving.  Until You return the keys to the accommodation or the withdrawal notice becomes effective, whichever is later, You will be liable for residence fees.  If you retain the keys for the accommodation beyond the withdrawal date, You will continue to be liable for residence fees until the date You return the keys, whether You occupy the accommodation or not.

5.6 If you fail to return the keys/access card at the end of the contract, You will be liable for a charge for both the cost of replacing keys/access card and for replacement locks.  

6. ROOM CHANGES

6.1 Room offers are subject to change and the University reserves the right to move students to suitable alternative accommodation, which may involve moving to a different residence.  If you remain in sole occupancy of a shared room, You will be liable for the single room rate for a) the duration/remainder of the tenancy; or b) until allocation of the second place to another student at the discretion of Student Accommodation Services. If You, in sole occupancy of the shared room, are unable to pay the single room rate You may be required to move into another shared room.

7. PAYMENT

7.1 If you fail to pay residence fees in accordance with the agreed payment schedule, You do not have permission to re-enter University owned or managed accommodation while the debt is outstanding; You must agree an acceptable repayment schedule with the University's Finance Department prior to permission being considered.  A late fee will be chargeable if you default on an agreed payment schedule. 7.2 The University has the right to instigate eviction proceedings against You should You fails to arrange and adhere to an acceptable payment schedule.

8. CODE OF CONDUCT

8.1 You are required to familiarise Yourself with the University's regulations and codes of practice as they apply to student residences and should note the consequences if You breach any of the codes of conduct or health and safety requirements.  You are personally responsible at all times for the conduct of Your visitors and guests on any part of the premises.

8.2 Infringement of any terms and conditions of the contract may lead to termination of the contract and permanent exclusion from University owned accommodation.

8.3 The Assistant Director of Residential & Business Services/Wardennial Team or their delegates are empowered to take disciplinary action against You should you  behave in any way prejudicial to the good order and smooth running of the residence.  They will confiscate any item which they believe may be prejudicial to good order and the safety of other residents.  The Assistant Director of Residential & Business Services/Wardennial Team or their delegate have the power to fine students and or require them to make good the cost in whole or part of any damage caused. In serious cases, the Assistant Director of Residential & Business Services or their delegate will take legal action to evict You from University Accommodation and ban any future return in conjunction with any of the above penalties. The Non-Academic Misconduct Policy or any review of the Policy that comes into effect during this contract, will be used to deal with other disciplinary matters. Provided, in the written notification of the decision, will be an outline of details of how to appeal the decision on a disciplinary matter.

9. PROCEDURES FOR EVICTION FROM UNIVERSITY ACCOMMODATION 

9.1 If you are in contravention of the Terms of Occupancy, You may face eviction proceedings from Your accommodation.  The Assistant Director of Residential and Business Services or their delegate on behalf of The Court of the University of St Andrews, will commence legal eviction proceedings and issue a 28 days Notice to Quit. The 28 day period of the notice includes vacations.

9.2 Should it is judged that You should not remain in the residence during hte period of the 28 day notice to Quit, the University will endeavour to provide a duty of care to You and alternative accommodation will be arranged to cover the period of notice. This will occur where Your continued presence may have a detrimental effect on an individual or individuals within the residence or to the community or staff as a whole. In the event You are subject to a suspension or termination of studies, the contract for accommodation may be terminated immediately without due notice.

9.3 Eviction from one residential unit bars You from accommodation in any other residence for the balance of the session or longer if so specified.

10. YOUR CONDUCT

You must ensure that You act within the Law ( and where applicable, Your guest/visitors ) do not:

10.1 Bring illegal drugs into University residences or misuse drugs in any part of the University's premises or property;

10.2 Cause other occupiers of University residences or any other person any injury, disturbance, disruption, annoyance, nuisance, harassment; inconvenience or damage to their property,

10.3 Act in a manner as to endanger the wellbeing of members of the University and/or the good order of the residence, or which is likely to bring the University into disrepute.  This includes (without limitation), for example, damaging fittings/furniture or anti-social behaviour resulting from excessive consumption of alcohol and/or consumption of drugs;

10.4 Cause any excessive or unnecessary noise in the Residence;

10.5 Permit others to occupy Your accommodation without the permission of the University;

10.6 Bring firearms and/or any other dangerous or offensive weapons (including without limitation, any replica firearms/weapons or parts of a weapon/firearm) onto any part of the University's owned or managed premises or property;

10.7 Hold social functions/parties on the premises without the prior written consent of the Wardennial Team and the Residential Services Manager.

10.8 Hang banners or flags or similar materials in windows or on the outside of the residence.

11. YOUR STUDY BEDROOM

You must ensure that You (and where applicable, Your guests/visitors)

11.1 Do not use the accommodation for any other purpose than living and studying;

11.2 Do not change or damage the decorative finish of the bedroom or any other part of the residence;

11.3 Do not damage University furniture or remove University furniture from the bedroom or any room in the University's residence.  All furniture must be in its original position at the end of the agreement.  Students will be charged for any damage to furniture or decoration arising from rearrangement.

11.4 Where damage occurs in an individual bedroom that is not commensurate with fair wear and tear, You, as the occupant of that room, will be liable for the damage. You should expect to be charged for the repair or replacement except in cases where you can demonstrate that You are not responsible for the damage. You are responsible for the behaviour of Your guests while the guest is in the Residence and for any damage that they may cause.

12. COMMON PARTS / SHARED FACILITIES

You must ensure that You (and where applicable, Your guests/visitors):

12.1 Jointly with the other occupants, keep any shared facilities such as a kitchen, bathroom, common or other room and adjoining corridors and stairwells allocated to You under this contract clean and tidy at all times and not permit rubbish/litter to accumulate therein;

12.2 Do not allow any shared facilities (including, without limitation, any cooking utensils contained therein) to become so unclean and unhygienic that, in the reasonable opinion of the University, they constitute a risk to the health of themselves or others.  Please note, in the event You fail to comply with any notice informing You of Your breach of this clause, You acknowledge and agree that any member of the University's staff and/or any person authorised by the University shall have the right to remove and dispose of any of the cooking utensils

12.3 You together with the other occupants in each house, flat or apartment will share the cost of any cleaning or damage, which occurs during Your tenancy, or the cost of replacing inventory items that are missing at the end of the contract.

13. OUR OBLIGATIONS

13.1 The University will provide the facilities and services set out in this contract. However, it will not be liable for any failure or interruption to any facilities and services or for any loss arising from such failure or interruption where it is caused by Your actions or the actions of any other student or by any circumstances beyond its reasonable control.

13.2 When You pay Your accommodation fees the University shall ensure that You become a beneficiary of the St Andrews University Hall of Residence Block Insurance Policy.  This provides You with basic insurance cover for Your possessions, and in certain circumstances (and to a set limit) Your bedroom.  Information leaflets giving details of the cover will be provided by the insurance company to the residence and You are responsible for familiarising Yourself with the extent of the cover.  You will be responsible for making any claims but prior to making any claims, You must contact Student Accommodation Services.

14. DAMAGES

14.1 You are responsible for any damage to your bedroom, its furnishings and its fittings and You must report all damage and losses to the Residential Services Manager within 24 hours of becoming aware of it.  You must not cause to be made or deliverately make any alterations to the premises or parts thereof; this includes without limitation the installation of TV aerials and satellite dishes. 

14.2 You will be liable to the University for all damage and/or losses suffered due to breach of this contract.  This includes (but is not limited to) any damage to any part of the premises or its contents caused by You or Your guests' wilful acts, omissions, negligence or any expense properly incurred in collecting arrears, paying professional advisors and in relation to court proceedings.  Such charges may include the cost of repair or replacement of University property (at the sole discretion of the University) and/or any additional cleaning costs.  The University shall be entitled to replace University property, which has been damaged by students if replacement costs are less than repair costs.

14.3 You are each jointly and severally liable for any damage caused within the shared areas of the residence.  We will solely determine the cost of such damage and we agree to act reasonably at all times.  The person who has caused the damage will pay the cost of the damage in the first instance.  In the event that it cannot be ascertained who has caused the damage, each occupant will be jointly and severally liable for the cost of the damage.

14.4 Please note that an inventory of the University's fittings, furniture and furnishings in student bedrooms will be provided to You on arrival and must be complete and signed (please see clause 3).

15. SPORTS EQUIPMENT

15.1 Certain sports equipment may also constitute an offensive weapon, including and without limitation, archery equipment, fencing foils and ice axes.   Prior permission must be obtained before you are allowed to bring such equipment into the residence.  If yo wish to bring such items into a residence, you should contact Student Accommodation Services in the first instance.  Confirmation will also be required from the Sports Centre that you are a bona fide user of this equipment within an official University club.  If in doubt whether any item constitutes an offensive weapon, consult the Warden or Residential Services Manager who, if necessary, will seek the advice of an appropriately qualified person.

16. HEALTH & SAFETY

You must not:

16.1 Allow your health or behaviour, in the reasonable opinion of the University, to constitute a serious risk to you or others or the University's or other people's property.  Please note that You will need to register with a local General Practitioner immediately on arrival at the residence in order to receive treatment in an emergency from a General Practitioner;

16.2 Bring onto or keep at any of the University's residences pets or any living animals (except for guide dogs and hearing dogs);

16.3 Bring Your own furniture, curtains, soft lampshades or halogen lamps into Your bedroom and/or the residence since all furnishings must comply with relevant safety legislation;

16.4 Cause any obstruction of any shared facilities such as a kitchen, bathroom, communal or other room allocated to You under this contract and those parts of the University's residence which are necessary for the purpose of gaining access to Your bedroom; this includes bringing bicycles inside;

16.5 Put anything harmful or which is likely to cause blockage in any pipes or drains;

16.6 Throw or drop anything whatsover from windows or balconies of any University residence;

16.7 Allow anyone into the residence unless satisfied that he/she is a resident, a guest of a resident or, are there with the University's authority.

You shall have regard to the safety and security of the premises and You must ensure that You (and where applicable Your guests/visitors):

16.8 Keep Your room/flat clean and tidy at all times and hand it over to the University upon early termination or expiry of this contract in a tidy, clean and good condition,

16.9 Make Your room available to the University as required for cleaning and/or maintenance at the times specified by the Residential Services Manager;

16.10 Immediately report to the Residential Services Manager/Property Manager any faults and/or repairs required to the premises or to the fittings and furniture.  Please note, if damage is caused to University premises or fittings and furniture due to your failure to report any faults when You become aware of them, You shall be responsible for any resulting costs of damage and/or losses suffered by the University.

16.11 Report the loss of any key and/or electronic device provided to You by the University to the Residential Services Manager or Wardennial Team immediately.  Please note, You shall be responsible for the reasonable costs of replacing any key and/or electronic device.

16.12 Keep Your bedroom door and window locked at all times when You are not in the room,

16.13 Where applicable, when entering and leaving the flat or residence ensure that the main entrance door is shut and locked behind You.

16.14 Allow the University upon reasonable notice and at reasonable times (save in the case of emergency when no notice is needed) to enter the accommodation to clean and undertake inspections or repairs or for any other reasonable purpose;

16.15 Show proof of Your occupation of the residence, such as their student identification card, to any member of the University's staff if they request You to do so.

17. FIRE AND ELECTRICAL SAFETY

17.1 The University takes NO responsibility for damages or injuries caused by personal electrical equipment within the residence.  You are  wholly responsible for the use and consequences of misuse of any electrical equipment You bring into the residence.  Where informed by You, the University will certficate all items of electrical equipment brought into the residence by You soon after the start of semester.  Any items brought into the residence after this period will need to be tested and certified at the Your own expense.  You can get advice on electrical safety from their Residential Services Manager.

17.2 Do not bring any electrical equipment from outside the United Kingdom as it may not be compatible with the voltage system and will fail the electricity safety certification test.

17.3 Do not abuse the fire alarm or associated safety systems and equipment, including covering smoke detectors.

17.4 Comply with all compulsory fire training arranged for the residence at the start of the academic year,

17.5 Only use fire exits in an emergency and keep fire routes clear of obstructions at all times,

17.6 Do not use candles, naked flames, decorative string lights, or joss sticks or do anything else that may constitue a fire hazard.  Please note, if You are found to be responsible for improperly activating a fire alarm, the University is obliged to report the incident to the Police.  Under the Fire (Scotland) Act 2005, any person who knowingly gives, or causes to be given, a false alarm of fire to the Fire Brigade may be liable on summary conviction to a fine and/or imprisonment.

17.7 Do not use fireworks, electric heaters, paraffin heaters, halogen heaters or gas heaters on the premises.

17.8 The use of all high-powered electrical equipment e.g cooking aparatus of any kind (other than those supplied by the residence), including, without limitation, deep fat fryers, rice cookers, kettles, irons, electric blankets, refrigerators, microwaves, electric rings is prohibited.

17.9 Do not interfere with electrical wiring or equipment nor overload any electrical circuits by the use of too many electrical appliances.  Personal electrical equipment used, including connecting leads, must be serviceable and in a safe condition.

17.10 Plugs are to be wired in the correct manner and fused according to the manufacturers' instructions.  You are to use a separate plug for each piece of equipment.  If additional sockets are required, multi-way distribution boards with 13 amp-shuttered outlets must be used.  You are prohibited from using cube adaptors.

17.11 The Warden/Residential Services Manager has right to refuse the use of (and, if necessary, remove from the bedroom and/or residence) any piece of electrical equipment within the residence.

18. NON-SMOKING POLICY IN RESIDENCE

18.1 There is a strict non-smoking policy operating throughout the residence system. You must not smoke, or allow any guest or visitor to smoke, in any part of the residence, including covered areas at entrances.  Where there is sufficient evidence to suggest that smoking has taken place or You and/or Your guests are caught smoking, You will be subject to disciplinary procedures.

19. GUESTS

19.1 Occupants of shared rooms may entertain guests only by mutual agreement with their roommate(s). Notification to the Residential Services Manager, Porter or  completion of the 'Guest Sign-In' Book must occur for all overnight guests. In the event of a fire all students in residence have to be accounted for. You are responsible for any costs incurred by Your guests e.g. hire of camp bed, meals taken etc.

19.2 You may have a temporary guest for a maximum of three days in any week and no more than twice in any four week period in houses/flats/apartments providing the other occupants agree. If the same person stays for a longer period or on a recurring basis, this is considered a permanent arrangement, which is a breach of the Terms and Conditions of Occupancy for the accommodation. If there are vacant rooms, which are not required for matriculated students, such rooms may be hired by You for a guest (charge payable to the Residential Services Manager). However, it is not possible to book vacant rooms more than three days in advance. The University accepts no liability for guests or their possession and students are responsible for the behaviour and action of their guests.

19.3 Any member of the University's staff and/or any person authorised by the University shall have the right to refuse admission to any guests and/or visitors.  In the interests of all residents, the Univesity has the right to refuse admission to any unaccompanied guests.

20. PROHIBITION ON SUB-LETTING OR ASSIGNING ROOMS

20.1 You must not, at any time, sublet, share or part with possession of Your accommodation or any other part of the Residence.  Your rights in the accommodation are not transferable to anyone else.

21. SECURITY

21.1 The opening hours of each residence are set by the Residential Services Manager/Warden and at other times when security personnel, porter are on duty or other security arrangements operate. You and the other students of the residence are expected to accept responsibility for security within the residence and within the grounds of the residence and You is responsible for the behaviour of Your guests.

22. PRIVACY OF RESIDENTS

22.1 Your privacy will be respected at all times and whenever practicable, 24 hours notice will be given of any visit other than by the Residential Services Manager, Warden, Director of Residential and Business Services, their deputies or duty personnel or cleaners. The University reserves the right of entry at any reasonable time by authorised personnel in the course of their duties.

22.2 In self-catering accommodation, to ensure that all flats, houses and apartments are kept in good order, there will be a monthly check of each apartment (including bedrooms) by the Housekeeping Supervisor/Manager. The Residential Services Manager will provide advance notification of when this inspection will take place. If the flat, house or apartment falls below the standards required, you and the other occupants will be given a specified time to rectify the areas highlighted. If on a re-check the areas have not been rectified the Residence Management Team will carry out the necessary measures and invoice the cost of this to the occupants.

22.3 An annual Health and Safety inspection is conducted in all properties and due to its nature no advance notice other than this will be given.

23. LOSS AND DAMAGE TO PROPERTY

23.1 The University Authorities accept no responsibility whatsoever for the loss of/or damage to any motor vehicles of whatever description or to bicycles parked on property belonging to the University.

24. WHEN YOU LEAVE

24.1 When You leave the accommodation upon termination or expiry of this contract however arising, You must leave all items belonging to the University (specified in the inventory) and immediately remove all personal belongings from the accommodation.  In addition, You must leave the accommodation in a good state and condition and return all keys and/or electronic devices to the Residence Management Team.  The University will charge students the reasonable cost of replacing any key and/or electronic device that is not returned and the reasonable cost of making good any damage to or, replacing any items specified in the inventory (see clause 3 above).  In addition to clause 3, if you do not comply with this clause the University reserves the right to charge:

24.2 Financial compensation equalling the amount You would have paid as accommodation fees from the end of their period of occupancy under this contract until the accommodation is cleared and the keys returned; and

24.3 For any reasonable expenses and administration costs incurred by the University due to the  immediate disposal  of any of Your personal belongings left on the premises on expiry or early termination of this contract.

25. COMPLAINTS PROCEDURE

25.1 If You wish to raise a complaint about the condition of the premises or about any issue arising from the Terms & Conditions of Occupancy, please ensure You do this in accordance with the Policy on Non-academic Complaints and Non-academic Appeals.  In  the first instance, all complaints should be referred to the Residential Services Manager.

26. DISCLAIMER

26.1 Subject to the provisions of the Occupiers Liability Act 1957 and the Defective Premises Act 1972 the University shall not in any circumstances incur any liability in respect of loss or damage to any person or property or otherwise unless the damage was caused by its negligence.

27. NOTICES

27.1 Any notice, communication or correspondence served in connection with this contract must be in writing and delivered by hand or, sent by first class post to Student Accommodation Services whose address appears on the offer letter.  In the case of notices served by the University, they will be delivered by hand or sent by first class post to Your accommodation or to any alternative address provided by You in writing.

28. DATA PROTECTION

28.1 The information held on Your accommodation application form(s) and in any other records or correspondence relating to Your accommodation are stored as part of the Your records on a database and as a manual records.  This data is held and processed in accordance with the requirements of the Data Protection Act 1998, the University of St Andrews' terms and conditions of occupancy and 'Code of Practice: personal information about students' http://www.st-andrews.ac.uk/students/rules/dataprotection/studentconfidentialitycode/  You hereby authorise the University to use Your personal data for all lawful purposes in connection with this contract (including debt recovery and crime prevention) or where there is a serious risk of harm to You or to others or to the University's property.

29. INVALIDITY

29.1 If any provision of this contract is found by any competent court to be invalid or unenforceable in whole or part, then the validity of the other provisions of this contract shall not be affected by them.

30. WAIVER

30.1 Failure or delay by the University to enforce any provision of this contract will not be construed as a waiver of any subsequent breach of the same or any other provision of this contract.

31. GOVERNING LAW

31.1 Exclusively Scottish Law and jurisdiction govern this contract, which,  for International students, may be different from what You are used to. You should make sure You read and understand these Terms & Conditions of Occupancy before accepting Your offer letter/online contract.
